Terms of Service
Last updated: September 22, 2026
Agreement to These Terms
These Terms of Service (the “Terms”) are a legally binding agreement between you and Matthew Lloyd (“WeightPilot,” “we,” “us,” or “our”) concerning your access to and use of the WeightPilot mobile applications for iOS and Android (the “App”), the website at https://www.weightpilot.com, and any related services we provide (collectively, the “Service”). By installing, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree with all of these Terms, you are expressly prohibited from using the Service and you must discontinue use immediately.
Supplemental terms or documents that we may post in the Service from time to time, including our Privacy Policy, are expressly incorporated into these Terms by reference.
The Service is not intended for distribution to or use by any person in any jurisdiction or country where such distribution or use would be contrary to law or regulation or would subject us to any registration requirement within that jurisdiction or country. If you choose to access the Service from other locations, you do so on your own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.
Health and Medical Disclaimer
WeightPilot is a general wellness tool. It is not a medical device, and it does not provide medical advice, diagnosis, or treatment. Consult a physician before changing your diet or exercise.
WeightPilot helps you track your body weight and offers general guidance intended to help you reach and maintain a target weight. The daily “throttle,” the “stable weight,” body fat estimates, targets, and every other figure the Service shows you are outputs of a mathematical model. They are estimates based on the data you and your connected devices provide, and they may be inaccurate, incomplete, or unsuitable for you. They are not a substitute for professional medical advice, and you should never disregard professional medical advice or delay seeking it because of anything shown in the Service.
Consult a physician or other qualified health professional before starting any weight management program or making changes to your diet, eating habits, or physical activity. WeightPilot is not suitable, without the supervision of a qualified health professional, for anyone who:
- is pregnant or breastfeeding;
- is under 18 years of age;
- has an eating disorder or a history of one; or
- has a medical condition, or takes a medication, that may be affected by changes in diet, body weight, or physical activity.
If you feel unwell, faint, dizzy, or otherwise experience any adverse symptoms, stop following the Service’s guidance and seek medical help promptly. If you think you may have a medical emergency, call your doctor or your local emergency number immediately.
You are solely responsible for your own decisions about what you eat, how you exercise, and how you manage your health, and for how you use the information the Service provides.
Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that: (1) you are at least 18 years old; (2) you have the legal capacity to enter into these Terms and you agree to comply with them; (3) any information you provide to us, including your email address and the measurements you enter, will be true, accurate, current, and complete, and you will keep it up to date; (4) you will not use the Service for any illegal or unauthorized purpose; and (5) your use of the Service will not violate any applicable law or regulation.
If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and to refuse any and all current or future use of the Service (or any portion of it).
Accounts
An account is optional. You can use the App anonymously, in which case your data is associated with your device rather than with an account. You may choose to sign in using a one-time code sent to your email address or using a passkey, for example so that your data can be kept across devices.
You are responsible for keeping your email account, your passkeys, and the devices you use to access the Service secure, and you are responsible for all activity that occurs under your account or on your device. Please notify us promptly at support@weightpilot.com if you believe your account has been accessed without your authorization.
You may delete your account, together with all of the data associated with it, at any time in the App under Settings → Account → Delete Account. Deletion is permanent and cannot be undone. Our Privacy Policy describes how we handle your data, including on deletion.
Acceptable Use
You may use the Service only for your own personal, non-commercial purposes and only in accordance with these Terms. You agree not to:
- Systematically retrieve data or other content from the Service to create or compile, directly or indirectly, a collection, compilation, database, or directory without our written permission.
- Create accounts by automated means or under false pretenses, or access the Service through automated or non-human means, whether through a bot, script, scraper, or otherwise, except through the App and website as we provide them.
- Circumvent, disable, or otherwise interfere with security-related features of the Service, or attempt to bypass any measure designed to prevent or restrict access to the Service or any portion of it.

- Impersonate another person or access or use another person’s account.
- Sell or otherwise transfer your account.
- Interfere with, disrupt, or create an undue burden on the Service or the networks or services connected to it.
- Upload or transmit (or attempt to upload or transmit) viruses, Trojan horses, or other material that interferes with any party’s uninterrupted use and enjoyment of the Service, or that modifies, impairs, disrupts, alters, or interferes with the use, features, functions, operation, or maintenance of the Service.
- Decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Service, except to the extent applicable law expressly permits this despite this restriction.

Intellectual Property
Unless otherwise indicated, the Service is our proprietary property, and all source code, databases, functionality, software, designs, models, text, photographs, and graphics in the Service (collectively, the “Content”) and the trademarks, service marks, and logos contained in it (the “Marks”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of the United States, foreign jurisdictions, and international conventions. Except as expressly provided in these Terms, no part of the Service and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever without our express prior written permission.
Provided that you are eligible to use the Service, you are granted a limited license to access and use the Service solely for your personal, non-commercial use. We reserve all rights not expressly granted to you in and to the Service, the Content, and the Marks.
The weight measurements and other personal data you enter or import remain yours. You grant us permission to store and process that data only as needed to provide the Service to you and as described in our Privacy Policy.
Feedback
If you send us questions, comments, suggestions, ideas, or other feedback about the Service (“Feedback”), you agree that it is non-confidential and that we may use and disseminate it for any lawful purpose, commercial or otherwise, without acknowledgment or compensation to you. You represent that any Feedback is original with you or that you have the right to submit it.
Mobile Application License
Use License
We grant you a revocable, non-exclusive, non-transferable, limited right to install and use the App on wireless electronic devices owned or controlled by you, and to access and use the App on those devices strictly in accordance with these Terms. You shall not: (1) decompile, reverse engineer, disassemble, attempt to derive the source code of, or decrypt the App; (2) make any modification, adaptation, improvement, enhancement, translation, or derivative work from the App; (3) violate any applicable laws, rules, or regulations in connection with your access to or use of the App; (4) remove, alter, or obscure any proprietary notice (including any notice of copyright or trademark) posted by us or the licensors of the App; (5) use the App for any revenue-generating endeavor, commercial enterprise, or other purpose for which it is not designed or intended; (6) make the App available over a network or other environment permitting access or use by multiple devices or users at the same time; (7) use the App to create a product, service, or software that is, directly or indirectly, competitive with or in any way a substitute for the App; (8) use the App to send automated queries to any website or to send any unsolicited commercial email; or (9) use any proprietary information or any of our interfaces or other intellectual property in the design, development, manufacture, licensing, or distribution of any applications, accessories, or devices for use with the App.
Apple App Store and Google Play
The following terms apply when you use an App obtained from either the Apple App Store or Google Play (each an “App Distributor”):
- These Terms are concluded between you and us only, and not with the App Distributor. We, not the App Distributor, are solely responsible for the App and its content.
- The license granted to you for the App is limited to a non-transferable license to use the App on a device that runs the Apple iOS or Android operating system, as applicable, and in accordance with the usage rules set forth in the applicable App Distributor’s terms of service.
- We are responsible for providing any maintenance and support services for the App as specified in these Terms or as otherwise required under applicable law. You acknowledge that the App Distributor has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
- In the event of any failure of the App to conform to any applicable warranty, you may notify the applicable App Distributor, and the App Distributor, in accordance with its terms and policies, may refund the purchase price, if any, paid for the App. To the maximum extent permitted by applicable law, the App Distributor will have no other warranty obligation whatsoever with respect to the App.
- The App Distributor is not responsible for addressing any claims by you or any third party relating to the App or your possession and use of it, including product liability claims, claims that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation, nor for the investigation, defense, settlement, or discharge of any third-party claim that the App or your possession and use of it infringes that third party’s intellectual property rights.
- You represent and warrant that (i) you are not located in a country that is subject to a U.S. government embargo, or that has been designated by the U.S. government as a “terrorist supporting” country, and (ii) you are not listed on any U.S. government list of prohibited or restricted parties.
- You must comply with applicable third-party terms of agreement when using the App, such as your wireless data service agreement.
- You acknowledge and agree that the App Distributors and their subsidiaries are third-party beneficiaries of these Terms, and that each App Distributor will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
Third-Party Services and Health Data Sources
The Service can work with services provided by third parties, including:
- Withings, whose connected scales can send your weigh-ins to WeightPilot after you authorize the connection with your Withings account;
- Apple Health (HealthKit) on iOS; and
- Health Connect on Android,
each of which can supply data such as body weight and active calories, depending on the permissions you grant. Your use of these services is subject to their providers’ own terms and privacy policies, which you should review. These services are not operated by us, and we are not responsible for their availability, accuracy, content, or practices, or for any data they supply to the Service. Referencing or integrating with a third-party service does not imply any endorsement of, or affiliation with, that service or its provider.
When you connect a third-party service, you authorize us to read, store, and use the data described in our Privacy Policy in order to provide the Service to you. You can disconnect a third-party service at any time, in the App or through the provider’s or your device’s permission settings. Disconnecting stops future imports; data already imported is handled as described in our Privacy Policy.
The Service may also contain links to other websites. We do not investigate, monitor, or check third-party websites or content for accuracy, appropriateness, or completeness, and we are not responsible for them. If you decide to leave the Service and access third-party websites, you do so at your own risk, and these Terms no longer govern. You agree to hold us harmless from any losses sustained by you or harm caused to you relating to or resulting in any way from any third-party service, website, or content.
Privacy
We care about data privacy and security. Please review our Privacy Policy, which explains what we collect, how we use it, and the choices you have. By using the Service, you agree to be bound by our Privacy Policy, which is incorporated into these Terms. The Service is hosted in the United States. If you access the Service from the European Union, Asia, or any other region with laws governing personal data collection, use, or disclosure that differ from applicable laws in the United States, then through your continued use of the Service you are transferring your data to the United States, and you expressly consent to have your data transferred to and processed in the United States.
Your Data
Although we take reasonable steps to protect and back up the data stored in the Service, you are solely responsible for the data you enter or import. To the fullest extent permitted by law, you agree that we shall have no liability to you for any loss or corruption of that data, and you waive any right of action against us arising from any such loss or corruption.
Fees
The Service is currently provided free of charge. We reserve the right to introduce paid features or subscriptions in the future. We will not charge you for anything without first giving you notice of the price and any additional terms, and you will not be charged unless you choose to purchase a paid feature.
Modifications and Interruptions
We reserve the right to change, modify, or remove the contents of the Service at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any information in the Service. We also reserve the right to modify or discontinue all or part of the Service without notice at any time. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.
We cannot guarantee the Service will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the Service, resulting in interruptions, delays, or errors. You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the Service during any downtime or discontinuance of the Service. Nothing in these Terms will be construed to obligate us to maintain and support the Service or to supply any corrections, updates, or releases in connection with it.
The Service may contain typographical errors, inaccuracies, or omissions. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information in the Service at any time, without prior notice.
Term and Termination
These Terms remain in full force and effect while you use the Service. You may stop using the Service at any time, and you may delete your account and its data in the App as described under “Accounts” above.
Without limiting any other provision of these Terms, we reserve the right to, in our sole discretion and without notice or liability, deny access to and use of the Service (including blocking certain IP addresses) to any person for any reason or for no reason, including without limitation for breach of any representation, warranty, or covenant contained in these Terms or of any applicable law or regulation. We may terminate your use of the Service or delete your account and any content or information associated with it at any time, without warning, in our sole discretion.
If we terminate or suspend your account for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party. In addition to terminating or suspending your account, we reserve the right to take appropriate legal action, including without limitation pursuing civil, criminal, and injunctive redress.
Disclaimer
The Service is provided on an as-is and as-available basis. You agree that your use of the Service will be at your sole risk. To the fullest extent permitted by law, we disclaim all warranties, express or implied, in connection with the Service and your use of it, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We make no warranties or representations about the accuracy or completeness of the Service’s content, including the throttle, stable weight, body fat estimates, targets, and other model outputs, or the content of any websites linked to the Service, and we will assume no liability or responsibility for any (1) errors, mistakes, or inaccuracies of content and materials; (2) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of the Service; (3) unauthorized access to or use of our secure servers and/or any and all personal information stored therein; (4) interruption or cessation of transmission to or from the Service; (5) bugs, viruses, Trojan horses, or the like which may be transmitted to or through the Service by any third party; and/or (6) errors or omissions in any content and materials or any loss or damage of any kind incurred as a result of the use of any content posted, transmitted, or otherwise made available via the Service. We do not warrant, endorse, guarantee, or assume responsibility for any product or service offered by a third party through the Service or any hyperlinked website, including any connected scale or health data platform.
Limitation of Liability
In no event will we or our employees or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the Service, even if we have been advised of the possibility of such damages. Notwithstanding anything to the contrary contained in these Terms, our liability to you for any cause whatsoever and regardless of the form of the action will at all times be limited to the amount paid, if any, by you to us during the six (6) month period prior to any cause of action arising. Certain state laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above disclaimers or limitations may not apply to you, and you may have additional rights.
Indemnification
You agree to defend, indemnify, and hold us harmless, including our agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of: (1) your use of the Service; (2) your breach of these Terms; (3) any breach of your representations and warranties set forth in these Terms; or (4) your violation of the rights of a third party, including but not limited to intellectual property rights. Notwithstanding the foregoing, we reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate, at your expense, with our defense of such claims. We will use reasonable efforts to notify you of any such claim, action, or proceeding that is subject to this indemnification upon becoming aware of it.
Changes to These Terms
We reserve the right, in our sole discretion, to make changes or modifications to these Terms at any time and for any reason. We will alert you to any changes by updating the “Last updated” date of these Terms, and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Terms to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms by your continued use of the Service after the date the revised Terms are posted.
Governing Law
These Terms and your use of the Service are governed by and construed in accordance with the laws of the State of New York applicable to agreements made and to be entirely performed within the State of New York, without regard to its conflict of law principles.
Dispute Resolution
Informal Negotiations
To expedite resolution and control the cost of any dispute, controversy, or claim related to these Terms (each a “Dispute” and collectively, the “Disputes”) brought by either you or Matthew Lloyd (individually, a “Party” and collectively, the “Parties”), the Parties agree to first attempt to negotiate any Dispute (except those Disputes expressly provided below) informally for at least thirty (30) days before initiating arbitration. Such informal negotiations commence upon written notice from one Party to the other Party.
Binding Arbitration
If the Parties are unable to resolve a Dispute through informal negotiations, the Dispute (except those Disputes expressly excluded below) will be finally and exclusively resolved by binding arbitration. You understand that without this provision, you would have the right to sue in court and have a jury trial. The arbitration shall be commenced and conducted under the Commercial Arbitration Rules of the American Arbitration Association (“AAA”) and, where appropriate, the AAA’s Supplementary Procedures for Consumer Related Disputes (“AAA Consumer Rules”), both of which are available at the AAA website www.adr.org. Your arbitration fees and your share of arbitrator compensation shall be governed by, and where appropriate limited by, the AAA Consumer Rules. The arbitration may be conducted in person, through the submission of documents, by phone, or online. The arbitrator will make a decision in writing, but need not provide a statement of reasons unless requested by either Party. The arbitrator must follow applicable law, and any award may be challenged if the arbitrator fails to do so. Except where otherwise required by the applicable AAA rules or applicable law, the arbitration will take place in Queens County, New York. Except as otherwise provided in these Terms, the Parties may litigate in court to compel arbitration, stay proceedings pending arbitration, or confirm, modify, vacate, or enter judgment on the award entered by the arbitrator.
If for any reason a Dispute proceeds in court rather than arbitration, the Dispute shall be commenced or prosecuted in the state and federal courts located in Queens County, New York, and the Parties hereby consent to, and waive all defenses of lack of personal jurisdiction and forum non conveniens with respect to, venue and jurisdiction in such state and federal courts. Application of the United Nations Convention on Contracts for the International Sale of Goods and the Uniform Computer Information Transaction Act (UCITA) is excluded from these Terms.
In no event shall any Dispute brought by either Party related in any way to the Service be commenced more than one (1) year after the cause of action arose. If this provision is found to be illegal or unenforceable, then neither Party will elect to arbitrate any Dispute falling within that portion of this provision found to be illegal or unenforceable, and such Dispute shall be decided by a court of competent jurisdiction within the courts listed for jurisdiction above, and the Parties agree to submit to the personal jurisdiction of that court.
Restrictions
The Parties agree that any arbitration shall be limited to the Dispute between the Parties individually. To the full extent permitted by law, (a) no arbitration shall be joined with any other proceeding; (b) there is no right or authority for any Dispute to be arbitrated on a class-action basis or to utilize class action procedures; and (c) there is no right or authority for any Dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.
Exceptions to Informal Negotiations and Arbitration
The Parties agree that the following Disputes are not subject to the above provisions concerning informal negotiations and binding arbitration: (a) any Disputes seeking to enforce or protect, or concerning the validity of, any of the intellectual property rights of a Party; (b) any Dispute related to, or arising from, allegations of theft, piracy, invasion of privacy, or unauthorized use; and (c) any claim for injunctive relief.
California Users and Residents
If any complaint with us is not satisfactorily resolved, you can contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834, or by telephone at (800) 952-5210 or (916) 445-1254.
Electronic Communications
Using the Service and sending us emails constitute electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically, via email and in the Service, satisfy any legal requirement that such communication be in writing. You hereby agree to the use of electronic signatures, contracts, and other records, and to electronic delivery of notices, policies, and records of transactions initiated or completed by us or via the Service. You hereby waive any rights or requirements under any statutes, regulations, rules, ordinances, or other laws in any jurisdiction which require an original signature or delivery or retention of non-electronic records.
Severability and Entire Agreement
These Terms and any policies or operating rules posted by us in the Service or in respect to the Service, including our Privacy Policy, constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of that right or provision. These Terms operate to the fullest extent permissible by law. We may assign any or all of our rights and obligations to others at any time. We shall not be responsible or liable for any loss, damage, delay, or failure to act caused by any cause beyond our reasonable control.
If any provision or part of a provision of these Terms is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Terms and does not affect the validity and enforceability of any remaining provisions. There is no joint venture, partnership, employment, or agency relationship created between you and us as a result of these Terms or your use of the Service. You agree that these Terms will not be construed against us by virtue of having drafted them. You hereby waive any and all defenses you may have based on the electronic form of these Terms and the lack of signing by the parties to execute these Terms.
